PHOTOGRAPH / MATERIALS RELEASE
By submitting this photo, image or other file (the “Work”), I hereby grant to DETROIT PUBLIC TELEVISION FOUNDATION (“DPTV”) and to its Great Lakes Now initiative, its successors, sublicensees and assigns the non-exclusive, worldwide, perpetual, irrevocable, royalty-free, fully-paid up right to reproduce, distribute, perform, display, publish and modify the Work in connection with Great Lakes Now. This includes, without limitation, any derivative or alteration. DPTV may use the Work in any promotion and for all purposes and in any manner whatsoever and in any media now known or hereinafter invented.
I grant DPTV, its successors, licensees, sublicensees and partners, assigns the non-exclusive worldwide, perpetual, irrevocable, royalty-free, fully-paid up right to use my performance and/or composition all in connection the exercise of the rights granted above. I agree that this grant includes the right to use my name, image, physical likeness and/or voice in any form, including, without limitation, a photograph, picture, artistic rendering, silhouette or other reproduction by photograph, film, digital image, video, tape, or otherwise.
I agree and acknowledge DPTV has no obligation to use the Work. In addition, I waive any and all rights I may have to inspect or approve of any use of my Work, in any manner that it is used in any final product. I agree that I have waived any compensation in connection with the Work, the foregoing grant of rights, or their subsequent exercise.
I warrant and represent that I possess all rights necessary for the grant of these rights and licenses. I warrant and represent that the exercise by DPTV of such rights and licenses will not infringe or violate the rights of any third party, including without limitation third party rights in contract, publicity or copyright.
I agree that I will defend, indemnify and hold DPTV and its licensees, sublicensees, partners and assigns harmless from and against any and all threatened or actual suits, actions, proceedings, liabilities, claims, damages, costs, expenses and fees (including attorney’s fees) arising from or related to any alleged or actual breach of this Agreement. I hereby releases DPTV from, and covenants not to sue DPTV with respect to, any and all claims or liabilities arising from or related to the Work or the program Great Lakes Now.
This agreement contains the full and complete understanding between the parties and supersedes all prior agreements and understandings and cannot be modified except by writing signed by each party. The federal and state courts of Michigan shall have exclusive jurisdiction over all disputes arising from or related to the Work, this Agreement [ or the Program].
I agree that am over 18 years of age and I have the right to enter into this agreement.
